What is total and permanent disability insurance?
Total and permanent disability insurance – often referred to as TPD insurance – covers you with a lump sum if you become permanently disabled or injured. For more details, please refer to our TPD information page.
How do TPD superannuation claims work?
If you can no longer work due to illness or disability, your superannuation fund may have insured you for Total and Permanent Disability (TPD) or income protection. In many cases, you may have cover for both. This additional insurance is separate from your superannuation account balance and can be worth hundreds of thousands of dollars. If you’re unsure whether your fund has TPD or income protection insurance – or both – please contact us for a free consultation.
If I have more than one superannuation fund, can I make more than one claim?
It is common to have multiple superannuation funds if you’ve worked for different employers, especially if those employers use preferred funds such as industry super funds. If any of your funds provide insurance cover, you may be able to claim under each one. When you choose us as your superannuation lawyer, we’ll investigate whether you can claim from each (or any) of your funds. Many of our clients have successfully claimed from major funds, including HostPlus, SunSuper, AustralianSuper, AMP, and REST.
What happens if the insurer rejects my claim?
Sometimes insurers reject a TPD superannuation claim for various reasons. Our process minimizes the risk of rejection by: - Taking detailed instructions regarding your claim and the circumstances of your injury or disability. - Thoroughly analyzing all available information. - Applying the relevant law to your situation. - Using our experience to anticipate how insurers might handle your claim. - Discussing any issues or challenges with you at every stage. If your claim is rejected, we have extensive experience in challenging such decisions. Please get in touch with us to discuss how we can help.
What can I do if I have other TPD insurance in addition to my superannuation policy?
If you hold extra private TPD insurance separate from your superannuation cover, we can assist you in two ways: - Claiming under that private policy. - Managing any claims under your superannuation policy. For more information about these services, please visit our TPD retail claims page.
Will I have a lawyer to manage my case?
Unlike many firms that use legal assistants as the primary point of contact, we ensure that your lawyer is with you from start to finish. As our client, you will deal directly with your dedicated lawyer throughout the entire process, supported by our experienced legal assistants.
